1. What does a Process Server do?

Delivering notices, summonses, and other important documents to parties involved in a court case is the responsibility of a process server.

Process servers must give concrete proof that the legal documents were served. Affidavit of service or proof of service is the name of the offered confirmation, which must be notarized or commissioned and handed to the person or business that requested that the papers be served. Legally, process servers must follow the guidelines set forth by the courts while serving papers.

 

2. What areas does your company serve?

We serve all customers in the Halifax Regional Municipality. If the document needs to be served outside of Halifax, Timberlea, Hammond Plains, Beechville, Hubley, Bedford or Dartmouth areas, a mileage fee is added. For an estimate, go to “Request a quick estimate” .

 

3. Does your company provide legal advice?

We do not provide legal advice. There are many helpful links in our “Useful Links” section.  For legal advice we recommend you contact a lawyer.

 

4. Can I order my documents served or court filing online?

Yes, all our services can be ordered online.  Our forms take less than a minute to complete. You can upload your documents as well.

 

5. Can you print my documents for me?

Yes, we can.  Printing is a service we offer.  When you order your service, request the documents be printed.

 

6. What happens if we are unsuccessful in serving the respondent with the legal document?

You are encouraged to return to court and inform the judge that the process server was unable to serve the respondents with the documents and that three attempts were made. The judge might grant you an alternative method of service.

 

7. How much does it cost to have documents filed and/or served?

8. How do I know attempts were made to serve my documents?

Each attempt will be recorded using our body cams.  A picture of each failed attempt will be sent to our client.

 

9.  Will my data and personal information be protected?

We have over 20 years of experience working with client’s personal information and electronic documents.  Our company abides by the Personal Information Protection and Electronic Documents Act (PIPEDA)

10. What is a Commissioner of Oaths?

A Commissioner of Oaths is a person appointed by the Minister of Justice under the Notaries and Commissioners Act to administer oaths and take and receive affidavits, statutory declarations and affirmations with the Province of Nova Scotia for use in the Supreme Court or any other court in Nova Scotia.

11. Can a Commissioner of Oaths notarize, certify or verify documents for authentication?

No. Documents for authentication must be notarized by a notary public.

12. Can a Commissioner of Oaths help draft documents?

No. Document production and drafting is not a function undertaken by Commissioners. If you need assistance with this, it is recommended that you consult with a lawyer to obtain independent legal advice.
